Welcome to CMS Brew. These Terms of Service ("Terms") govern your access to and use of the CMS Brew platform, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Definitions
- "Company," "we," "us," or "our" refers to CMS Brew.
- "User," "you," or "your" refers to the individual or entity accessing or using the Service.
- "Customer Data" refers to any data, content, or materials that you upload or submit to the Service, or that we access on your behalf through connected integrations, including your website content, repository files, images, and the edit instructions you provide.
2. Access and Use of Service
2.1 Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2.2 Account Registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials.
2.3 Acceptable Use
You agree not to modify, reverse engineer, decompile, or create derivative works of the Service. You agree not to use the Service for any illegal purpose, to transmit any viruses, malware, or harmful code, or to publish content that you do not have the rights to publish.
2.4 Connected Repositories and Publishing
When you connect a code repository or hosting provider, you authorize the Service to read from and commit to that repository and to trigger deployments on your behalf. You are responsible for reviewing changes before they are published and for the content you choose to publish to your live site.
3. Intellectual Property
3.1 Company IP
The Service, including its software, algorithms, designs, and content (excluding Customer Data), is the exclusive property of CMS Brew and its licensors.
3.2 Customer Data
You retain all rights and ownership in your Customer Data. You grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and display your Customer Data solely for the purpose of providing, maintaining, and improving the Service.
4. AI Services and Disclaimer
CMS Brew uses artificial intelligence ("AI") and large-language-model technologies to interpret your plain-language requests and generate content changes ("patches"). You acknowledge that:
- AI-generated outputs are probabilistic and may contain errors, inaccuracies, or unintended changes.
- You are responsible for reviewing changes before publishing them to your live site.
- We do not guarantee that the AI features will be error-free or uninterrupted.
5. Fees and Payment
Certain features of the Service are available only through paid subscriptions. Free trials may be offered and may be changed or ended at our discretion. By selecting a paid plan, you agree to pay the applicable fees. Fees are generally non-refundable, except as required by law. We reserve the right to change our pricing upon notice to you.
6. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
IN NO EVENT SHALL CMS BREW BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.
